Responsable del tratamiento de tus datos personales

PRG Retail Group Spain, S.L.U., (PRG), con CIF B10704245, y domicilio administrativo en Avenida de Aragón 402, Edificio Allende, sexta planta, 28022, Madrid, e inscrita en el Registro Mercantil de Barcelona – Tomo 48366 – Folio 8 – Hoja B-581573- Inscripción 1ª, recoge y procesa los datos personales que nos has proporcionado, como cliente, futuro cliente, o por el uso que haces de nuestra web. Esta Política de Privacidad se ha creado de conformidad con el Reglamento 2016/679, de Protección de datos y demás normativa de aplicación sobre la materia. Esta Política se limita a los residentes de la Unión Europea que utilizan nuestra web o son titulares de la tarjeta TOYS y tiene por finalidad explicar qué información personal nos has proporcionado y cómo la usamos para comercializar nuestros bienes y/o ofrecer nuestros servicios. PRG comercializa bienes y presta servicios a sus clientes. Por ello, somos el Responsable del tratamiento de datos según la normativa de Protección de Datos Personales. Incluimos en esta Política de Privacidad un resumen de tus derechos para que puedas controlar cómo usamos tu información personal. PRG te informará sobre cualquier actualización que pueda afectar al tratamiento de tus datos personales. Tu compra periódica, a través de nuestras tiendas y/o sitio web, y/o el uso de nuestros servicios indicará que conoces las actualizaciones que hagamos sobre esta Política de Privacidad.

¿Qué información personal nos proporcionas?

Tu información personal incluye cualquier información que se relaciona contigo en la que se te identifica o puedes ser identificado. Esto incluye tu nombre, dirección, teléfono fijo móvil, e-mail, información de pago, historial de compras, destinatario de la compra, direcciones de entrega, nombres y edades de niños, amigos, parientes, etc.

¿De dónde proceden tus datos personales?

Recopilamos diversos tipos de información personal procedente de diferentes fuentes como, por ejemplo:

• La información que nos proporcionas cuando abres una cuenta en nuestra web.
• La información que nos proporcionas cuando te das de alta en el Family Club de Toys”R”Us y PRENATAL
• La información que nos proporcionas cuando te registras en la web para comprar los productos que nos solicitas.
• La información que recogemos sobre el uso que haces de nuestros servicios, ofertas y promociones.
• La información sobre el uso que haces de nuestra web, apps y cualesquiera actividades promocionales relacionadas.

Alguna de la información personal que nos proporcionas puede incluir datos de salud u otras categorías sensibles o especiales. No tratamos categorías de datos sensibles o especiales sin tu consentimiento expreso.

¿Con qué finalidades tratamos tus datos?

Toda la información personal que obtenemos de ti es usada para proporcionarte los productos que nos has solicitado o para un tercero que nos digas; para cumplir con nuestras obligaciones contractuales de proporcionarte servicios, así como para gestionar tu cuenta personal. Por favor, ten en cuenta que tu respuesta negativa u objeción para proporcionar la información personal necesaria con estas finalidades podría impedir a PRG prestar alguno de los servicios mencionados.

Nos gustaría usar tu nombre y dirección de correo electrónico para informarte también de nuestros productos, servicios, ofertas y promociones, así como para enviarte cupones descuento para canjearlos por productos que comercializamos. Por ello, cuando hayas realizado una compra en nuestra web o en nuestras tiendas podremos enviarte comunicaciones de marketing, publicitarias o promocionales sobre productos similares a los adquiridos con el fin de que estés al tanto de nuestras novedades y actividades. Te ofreceremos el derecho de darte de baja en cada comunicación electrónica mediante correo electrónico o a través de nuestra web.

¿Por cuánto tiempo conservamos tus datos?

Conservaremos tus datos personales durante el tiempo que dure la relación comercial con PRG y durante los cuatros años posteriores a la última compra que hayas realizado. Después de que este período haya expirado, toda tu información personal se suprimirá automáticamente.

¿Cuál es nuestra legitimación para el tratamiento de tus datos?

En concreto, tratamos tus datos sobre la base de nuestros intereses legítimos comerciales para gestionar cualquier asunto técnico o solicitudes de apoyo que puedan surgir para cumplir con nuestras obligaciones comerciales, legales y contractuales. Además, nuestros intereses legítimos o los que proceden de terceros pueden obligarnos a usar tu información personal en procesos judiciales o para otras finalidades legales que puedan afectar a PRG, pudiendo incluir la necesidad de transferir tu información personal a terceros países con normativa de protección de datos baja. En ese caso, tomaremos las medidas adecuadas para proteger tu información personal como exige la normativa de Protección de datos.

PRG salvaguardará la privacidad y la seguridad de categorías especiales de información de conformidad con lo exigido por la normativa de Protección de datos.

También usamos tu información con finalidades publicitarias, promocionales y/o de marketing donde, si no has comprado ningún producto en nuestra web, debes darnos tu consentimiento para recibir comunicaciones para esta finalidad. Puedes decirnos en cualquier momento que no quieres recibir comunicaciones con esta finalidad aunque nos hubieras dado tu consentimiento con anterioridad. También estamos legitimados para tratar tu información personal con el fin de cumplir con nuestras obligaciones contractuales y legales, siempre de conformidad con la normativa de Protección de datos.

¿A qué destinatarios comunicaremos tus datos?

Si en algún momento enviásemos tu información personal a quien pudiera estar localizado fuera de la Unión Europea, proporcionaremos un nivel adecuado de protección de tu información personal, incluyendo medidas de seguridad, técnicas y organizativas apropiadas a través de la realización de protocolos de transferencia apropiados que aseguren que se realiza conforme la normativa aplicable.

Tu información personal es tratada por entidades localizadas en la Unión Europea, la cual se almacena en servidores localizados en dicho territorio.

No permitimos que ningún tercero tenga acceso a tu información personal, excepto cuando sea requerido o permitido por la normativa aplicable de acuerdo con esta Política de Privacidad. Podemos comunicar tu información personal a nuestros subcontratistas, agentes o proveedores de servicios de pago con los que hemos contratado para que nos asistan en la prestación de servicios, con la condición de que dicho subcontratista o agente consienta por escrito cumplir con los estándares de seguridad y privacidad descritos en esta Política. Si el destinatario está localizado en un país en el que no tiene leyes de Protección de Datos adecuadas y no está certificado bajo “Privacy Shield”, formalizaremos cláusulas contractuales estándares para proteger tu información personal transferida en la forma aprobada por la Comisión Europea. Puede haber otras situaciones en las que podríamos facilitar a terceros tu información personal:

• Para cumplir tus pedidos y/o realizar los servicios, promociones u ofertas en las cuales has participado.
• Para cumplir con la Ley, responder a algún procedimiento judicial, petición de información de un organismo regulador o cualquier otra finalidad legal o
• Para proteger los derechos, la propiedad o la seguridad de PRG, socios, clientes o cualesquiera basado en intereses legítimos de PRG de acuerdo con la normativa de Protección de datos.
• Por los acuerdos de colaboración que hayamos alcanzado con proveedores de servicios y/o productos afines a nuestra actividad, que cumplen los estándares de protección exigidos, con el fin de que puedas recibir información y/o promociones de estos proveedores. Puedes decirnos en cualquier momento que no quieres recibir comunicaciones con esta finalidad aunque nos hubieras dado tu consentimiento con anterioridad.

Podemos compartir tu información personal con otras entidades comerciales en relación a la venta, cesión, fusión u otra transmisión de todo o una parte del negocio de PRG a esa entidad comercial. PRG también puede comunicar tus datos personales a las autoridades que los hayan requerido. En cualquier caso, cuando tengamos que compartir tu información personal con terceros restringiremos la naturaleza y las categorías de la información personal que se requiere. Podemos reidentificar tu información personal para proteger tu intimidad.

¿Cómo protegemos tu información personal?

PRG entiende que la custodia de datos de forma segura es esencial. PRG almacena la información personal y otros datos usando medidas de protección físicas, técnicas y administrativas razonables para asegurar los datos contra riesgos previsibles, como un uso no autorizado, acceso, revelación, destrucción o modificación. Aunque hagamos esfuerzos de buena fe para custodiar la información que obtenemos en un entorno operativo seguro, que no está disponible para el público en general, no podemos garantizar la seguridad completa. Mientras trabajamos para asegurar la integridad y la seguridad de nuestra red y sistemas, no podemos garantizar que nuestras medidas de seguridad prevendrán a los “hackers” de obtener ilegalmente esta información.

¿Cuáles son tus derechos cuando nos facilitas tus datos?

Tienes derechos relacionados con tu información personal, como se expone a continuación, quedando sujetos a la normativa de Protección de Datos:

• Tienes el derecho de tener acceso a tus datos y asegurar que tu información personal sea exacta;
• Tienes el derecho de revocar tu consentimiento en cualquier momento en relación con la información personal que sea procesada en base a tu consentimiento (la revocación no debe afectar la legalidad del tratamiento basado en el consentimiento antes de su revocación)
• Te puedes oponer al tratamiento de tu información personal, incluso para cualquier acción con finalidad de marketing directo;
• Tienes el derecho de solicitar cualquier corrección de tus datos personales o que suprimamos tu información personal;
• Tienes el derecho de solicitar que restrinjamos el tratamiento de tu información personal (esto puede poner en peligro, sin embargo, nuestra capacidad de proporcionarte nuestros bienes y/o servicios)
• También tienes el derecho de transferir tu información personal a otro proveedor de servicios, donde esta información sea tratada sobre la base del consentimiento, y después de tu solicitud por escrito, te proporcionaremos tu información personal relevante en un formato adecuado para trasladarlo a otro proveedor de servicios.
